Issues of land management within Ngarrindjeri lands ie the Adelaide plains

Hello tot the Federal Attorney General the Honorable Robert  McClelland and to your office from Kym and Rachael Maxwell

Police report number 11/CO2828 described to the SA Police how my wife was intimidated by an intruder onto our property and recent damages we have incurred. The officer reported the background and the allegations we have made under parliamentary privilege; we have alleged that factions within the ....................... and other business associated, have acted in a covert way to criminally malign our family in order to silence us. (words to that effect were placed on SA Police files by the officer reporting)

As you are aware we are alleging that our family has been menaced by peoples associated to factions within the ........................ and business groups associated to them, linked to property development deals within Ngarrindjeri lands. Being genetic descendants of the region we are connected to the land by Indigenous lore and that lore tends to correlate with Crown law; thus violations of law come to us in the dreaming and we convey that to the Government of Australia. Our activities that support natural lore-law have made us unpopular with those who are intent upon the exploitations of Aboriginal rights and thus we are alleging that those peoples associated are the peoples involved with the criminal persecutions upon our family, spanning decades.

  • Within the concepts of International law we do hold certain rights that can never be extinguished and those rights are yet to be satisfied or fully negotiated to date; thus the probable occurrence of the legal violation of rights being further disclosed in the dreaming is likely to continue, until this matter is reconciled.
  •  Whilst we are dwelling without adequate security within this current circumstance of legal jeopardy, we are liable to continue to be criminally violated unless the Government agrees to protect us or the other opposing parties are subdued from committing covert criminal attacks upon us.
  • It is our wish that the State takes over full management responsibilities for Indigenous Title matters within our region and are held accountable for the damages to property and to those adversely affected immediately and that the Government is able to act with a duty of care to provide security, adherence to lore-law and the protection of property, environment and Aboriginal peoples forthwith. 
  • There are important matters in the dreaming that need to be considered as the security and safety of the total population of the region might be affected by various degree; if actions are not implemented to prevent certain catastrophic events from causing a severe regional impacts on people and property (I will forward a report in due course to explain further, as to my concerns)
  • A major concern is the transfer of Crown lands and Crown rights to business without the consent of the appropriate Indigenous  persons as that property is in fact Indigenous communal property that should be held in trust as a heritage and protected on behalf of the peoples of Australia, held by the State as a National equity. The Indigenous people of Australia should enjoy benefit from their heritage as a natural property right to be shared in an equitable and sustainable way.
  • Certain land management in sensitive ecological regions needs to be further accessed as to the risk management for the region and future environmental impacts upon the community; Indigenous regional consultations of the appropriate Indigenous persons should be considered.   • The impacts of constant harassment, property damage, bullying and intimidation that are associated to the above mentioned circumstances has impacted on our family; our capacity to earn an income, gain employment and education etc. It is my understanding that others of  tribal origins may be similarly suffering but unable to respond; we urge the Government to take action against any regimes who are using Government resources to malign Australian citizens.

The Evil Visitors In The Dreaming: The Men In Black

Hello to the Hon. Robert McClelland, Federal Attorney General and to MP Tony Abbott, leader of the opposition
 
I dreamed that I was approached by two men wearing identical black suits, hats and trench coats. They approached me at a bar and asked if I was Mr Maxwell. I replied yes and one of them said something like do you smoke. Because he spoke softly I failed to respond and then he said do you sell drugs. Again I failed to respond and he said aha you are guilty. I then responded and said, because of your action any further conversations will be in writing only.
1 The last time I was approached by two men who threatened to plant drugs on me, in reality, was in 1994. They claimed to be very blue (Gov security). Within a week of that conversation I was drugged in a restaurant and there was an attempt on my life. That incident was revealed in the dreaming to associate to motor-cycle gangsters, Indigenous water rights and land developers.
2 The two guys in this dream are obviously nasty lawyers who are linked to Indigenous rights deals and developments.
3 Prior to the 1994 hit on me, the Penrice Salt Co. tried to force me using their lawyers to accept a restraining order. I was virtually threatened by their lawyer to accept or else. It is on the court file that I attended court, explained my case and no restraining order was applied to me.
4 After that incident I have alleged that my family was covertly-constantly harassed and terrorised by motorcycle gangsters (spanning more than a decade of terrorism and abuses), the Police failed to act to protect us. It is in the dreaming that the Penrice Salt Co. were associated to Bikers.
No matter how small the incident, talk or whatever I might suspect, I will be making a note of that on Government file. There are many who are associated to trading drugs and some of those are professional people (and probably within the Gov). I do not used or trade in illicit drugs and I avoid contact with those I know of who do.

Indigenous Priori Rights

My comments re the harvesting and killing of molluscs for the purpose of obtaining the animals' shells for commercial purposes did not include any reference to indiginous people. Commercial shell dealers have been engaged in such activities for a long time, but as more collectors take up shell collecting as a hobby, there has emerged informed opinion that the practice of collecting live animals has the potential to threaten the sustainability of populations of rare species. Hence importing shells from overseas is now subject to greater scrutiny.

Prof........... Relating to our discussion as to the selling of shells by Indigenous peoples. It could be argued that whilst Indigenous peoples are sustainably harvesting a traditional resource such as shells; the ecologies proving the resource and region are being managed and protected by the inhabiting Indigenous population. If Indigenous peoples rights to harvest any resource is impeded by another Governance or peoples; the original peoples may have rights under the Human Rights Act, International Law and the United Nations, to claim priori rights to compensation for their dispossession and loss of their livelihood. It is my view that if Indigenous peoples are dispossessed of a resource, they should indeed be compensated and with the view that those funds being acquired are used for the environmental protection of their resource-region. This could include a provision for the education and employment of the Indigenous parties who are dispossessed. Indigenous Protected Areas (IPA) could be regarded as a National equity that is a vital part of environmental health and health of the broader community. IPAs provide areas to sequestrate carbon, to nurture endemic habitat, medicines, a source of natural biomass and organic food etc. It could be argued that many areas currently being resource exploited and damaged fall into this category (including Crown lands, coastal and river-estuary systems).
I am not in favour of the unsustainable raping and pillaging of natural resources.

Indigenous Peoples as A Priori Rights-Holders
Many parks in Asia were home to indigenous peoples long before they were declared protected areas, and often indigenous peoples used those areas long before the creation of the state that now claims sovereignty over the lands. These indigenous communities thus hold a priori or customary rights over the land and removing them from the area constitutes a violation of their rights. Strong opposition is expressed especially by those who were forcibly moved without suitable alternative land for settlement and continuation of their traditional ways of life. Some communities are still seeking redress and restitution of their land.
Article 10 of the U.N. Draft Declaration on the Rights of Indigenous Peoples states “indigenous peoples shall not be forcibly removed from their lands or territories. No relocation shall take place without the free and informed consent of the indigenous peoples concerned and after agreement on just and fair compensation and, where possible, with the option to return.” The process of gazetting parks has indeed violated national and international laws, which provide for the delivery of free, prior, and adequate information to affected people before park development plans are enacted. In most cases, this consultation has not occurred and even if it has, the decisions to establish parks have already been made and alternate options were not given to communities.
The International Labor Organization convention on indigenous people (ILO 169), the Organization of American States-proposed Declaration on the Rights of Indigenous Peoples, the International Convention on the Elimination of All Forms of Racial Discrimination, the International Convention on Civil and Political Rights, the Ramsar Convention, the World Heritage Convention, Agenda 21, various World Conservation Union (IUCN) resolutions, and World Wide Fund for Nature principles are but some examples of legal and policy instruments that recognize indigenous peoples’ rights to lands, territories, and natural resources. The U.N. Draft Decalration also states in numerous articles that indigenous peoples have the rights to maintain culture, religious traditions, languages, education, and economic, political, and social systems. This survival is only possible if indigenous peoples have direct relationships with their traditional lands and territories.

Thankyou for the response.
If the coastal, rivers and estuary systems fall within regions of an Indigenous Title, acting within the question of priori rights; all resouces associated  may fall into a category affecting the rights of harvest. We would hope that the shells we sell are supporting Indigenos communities within their regions. Many shells are from old collections, the particular importer that we deal with is highly respected within his field. I share your concern if the resources were not being managed in a sustainable way or if shells are being taken in an illegal manner and without the consent of the appropriate authority.

The dreaming: Men In The Black Suits

I dreamed that I was approached by two men wearing black suits and black trench coats. They appeared as detective types but very nasty men. One of the men muttered something about do I smoke? I had been drinking and did not understand what he said and then he said do you sell it. He then said aha got you. I then realized that he was referring to drugs and I denied any involvement with this conversation. I insisted that I would no longer converse in this way and that if he wanted to communicate with me it would have to be in writing.
This is the second dream implicating me to drug use? Hahahaha I don't touch the stuff, not even with a barge pole. I avoid contact to any who are users and that means even soft drugs. I was approached in 1994 by two men in a similar way and that approach preceded an attempt on my life when I was drugged in a restaurant by a female. This linked to the Nema family and the dreaming indicated that Native Title, Crown property and water rights were involved. The two men who approached me in 1994 claimed that they were very blue=federal institutional chaps. This recent dream with the men in black would indicate that they are linked to the legal fraternity who are linked to Native Title business, that is linked to various forms of corruption and in turn is linked to property development and lucrative land and resources deals.
The disturbances to and undermining of Aboriginal peoples, whilst the underworld and lawyers manipulate heritage rights? This is probably not the best way to proceed. If the personal attacks on my family escalate, then we will probably soon find out exactly who is behind the mischievous behaviour. AHA :) I have been sensing that there is an undertone of bother about town and that this is related to those who have been exploiting Native Title in various ways. Perhaps those intuitions are correct? As the dreaming continues to expose corruptions and protect the heritage rights of Indigenous peoples, those criminal types who are implicated are becoming more anxious. Who are they? hhaahhaa: they may be related to Aboriginal business, land, resources the councils and the legal fraternity :).
